On May 26, 2026, the Ministry of the Interior published a booklet to assist employers in recruiting foreign workers in France. Through this practical guide, the administration aims to streamline recruitment processes while facilitating the integration of foreign talent into the French labor market.
The document outlines a six-step process enabling employers to recruit foreign employees within a clear and secure framework:
1) Verify the right to reside and work: This first step ensures that the applicant has a valid residence permit in France that allows them to work (excluding permits for "visitors" and "retirees," for example). It is necessary to verify whether the valid residence permit directly authorizes work or if additional work authorization is required.
2) Verify the authenticity of documents: Employers are advised to verify the authenticity of the documents presented. Tools and procedures are available to them, including the possibility of contacting the prefecture to verify certain residence permits.
3) Check the conditions for practicing regulated professions: for professions subject to specific regulations, the employer must ensure that the candidate has the authorizations, qualifications or accreditations required to carry out the activity concerned.
4) Anticipate the work permit application: the procedures must be carried out well before the hiring date.
5) Declare the hiring: as with any recruitment, the employer must carry out the mandatory formalities, in particular the Prior Declaration of Hiring (DPAE).
6) Ensure follow-up throughout the employment relationship: the booklet reminds us of the importance of administrative follow-up of the employee throughout their professional career.
This guide, beyond reminding employers of their legal obligations, reflects a desire to make the procedures applicable to the employment of foreign nationals more transparent.
